    To buy Crude Oil From MALAYSIA:

     – Product Title:Light Crude oil API 33.60
    Heavy Crude oil API 16.00
    Extra Heavy Crude oil 10.00
    – Contract: SPOT
    – Origin: Malaysia
    – Term of Delivery: FOB Malacca Port of Malaysia.
    – Payment Term: TT/LC
    – Validity: Two Weeks Procedure (FOB)1-Buyer sends LOI, account`s CIS, Company profile, Scanned of Buyer\’s International Passport.2-Seller sends FCO and Buyer sign the FCO and return to Seller.3-Seller issues draft SPA for Buyer’s review and after endorsement returns to Seller, then Seller sign SPA and send for Buyer. (it is possible for Buyer to meet Seller in Malacca)4-Buyer sends Q88 & IMO# and vessel Capitan contact`s call info.5-Seller arranges loading and gives Lay-can for loading to Buyer.6-Seller loads product to the vessel and once loading completed the Seller prepare related shipping documents.7-Buyer organizes Q&Q by SGS Co. or similar and Seller issue final Commercial Invoice (CI) for Buyer according to the Q&Q report.8-Buyers\’ Bank releases full CI amount to the Seller’s Bank account and title of ownership is transferred to the Buyer name.9-Vessel forward for the destination port.10-After successful completion of First Lift Shipment, further supply continues following SPA, whereby timing of deliveries is planned and agreed upon beforehand between Seller and Buyer in a separate loading and delivery schedule. Note 1: Buyer is always entitled to do an additional Q&Q by SGS or equivalent international agency on Buyer’s own expense. Note 2: Due to the transaction in the ASEAN area, the customer must include a 7% tax deduction in the calculation of the costs.

    The process that practically reaches NIOC:
    – The customer issues an LOI with the name of the refinery

    After the agreement of the parties
    – The SPA contract is concluded.
    – The buyer will pay ten percent of the amount in advance based on the PI that NICO will give to the seller.
    – After the ship arrives at its destination in CFR, the buyer performs the Q&Q test and after confirmation by the buyer,
    – He will pay the balance to the seller for shipping and cargo documents

    Procedure (FOB)

    1. Buyer issues LOI including a soft BCL. Seller’s representative issues SCO to the Buyer. Upon receiving the SCO a zoom meeting takes place with the buyer and seller’s representative after signed SCO.(Buyer’s lawyer presence is advised)
    2. Buyer issues an official ICPO with the received SCO attached. The ICPO should indicate seller’s procedure & terms (signed/Sealed).
    3. Seller Issues draft contract (SPA)-Sales and Purchase Agreement- for both parties’ final endorsement.

    4. Seller appoints and signs Charter Party Agreement (CPA) along with the buyer and the shipping company. Buyer and seller receive PPOPs and CI (from shipping company) to be paid by both parties as 50/50 for transporting the product to buyer’s final discharge port.
    (Note: This fee will be deducted from the total product value at the end of delivery).
    Meanwhile the buyer receives PPOP documents as below:
    (a) CONFIRMATION / COMMITMENT LETTER TO SUPPLY
    (b) TANK RECEIPT
    (c) CERTIFICATE OF ORIGIN OF THE PRODUCT
    (d) STATEMENT OF AVAILABILITY OF THE PRODUCT IN RESERVOIR (e) PRODUCT PASSPORT
    5. Upon payment of the CI and finalization of the logistics for delivery of the petroleum product to the buyer’s nominated destination/discharge port, seller commences loading the petroleum product into the vessel tanker (ship) provided by seller and issues the following proof of product and shipment documents to the buyer:
    • BILL OF LADING, VESSEL DETAILS (Q88).
    • DIP TEST REPORT FOR QUALITY AND QUANTITY OF THE PRODUCT BY SGS, SAYBOLT, INTERTEK OR SIMILAR
    • CERTIFICATE OF CONFORMITY OF THE PRODUCT
    • CERTIFICATE OF ORIGIN ISSUED BY THE CHAMBER OF COMMERCE
    6. Upon receipt of the above proof of product and shipment documents, buyer Issues DLC MT700 or SBLC MT760 to guarantee the payment for the product and seller Issues 2%P.B.
    7. Shipment commences and buyer releases payment via MT103 – T/T for the total cost of the product after CIQ at buyer’s discharge port and seller hands over all exportation documents and certificate of ownership to the buyer through the ship’s captain.
    8. Seller pays commissions to intermediaries involved in the transaction
    Note:
    – Before paying 50% shipping (CPA) , the customer is given SPA that can inquire from the commercial department of the Russian Embassy, with this inquiry, the customer is assured of the authenticity of the seller.
    – Also, during the zoom meeting, the client\’s lawyer must be present.
